I. GENERAL PROVISIONS

The user is a natural person using the website https://zefirutv.pl/.
The Administrator, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”), respects and fully acknowledges Users’ right to privacy and personal data protection, and therefore processes the necessary Personal Data in accordance with the GDPR, the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2018, item 1000), the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended), and the Telecommunications Law of 16 July 2004 (consolidated text: Journal of Laws of 2017, item 1907, as amended).
This Privacy Policy aims to generally describe how and to what extent Users’ Personal Data is collected, for what purposes this Data is used, to whom it is shared, and how it is protected. In the Privacy Policy, the User will also find information about what rights Users have under applicable personal data protection laws.
This policy is general in nature and presents the most important issues related to the processing of personal data. This policy is supplemented by individual terms and conditions or information clauses that you will receive when your personal data is collected in connection with specific services, such as subscribing to the Newsletter, using the contact form (booking a test drive, requesting contact, requesting a quote).
The Administrator takes all available technical and organizational measures to ensure the protection of Users’ personal data processed, appropriate to the threats and the category of data protected, and in particular takes all actions to secure the data against unauthorized access, theft, processing in violation of applicable legal provisions, and alteration, loss, damage, or destruction.
Personal data provided by the User on the Zefir UTV website is encrypted and protected using an SSL certificate.

II. PURPOSE AND SCOPE OF DATA COLLECTION

1. The Users’ Personal Data collected by the Administrator is used solely for the purposes of:

a. responding to User inquiries via email or phone – the legal basis for these actions is the processing of data necessary to take steps at the request of the data subject,

b. marketing purposes – with the User’s explicit consent – in accordance with Article 6(1)(f) of the GDPR,

c. for the purpose of scheduling a test drive or responding to User inquiries and complaints using contact forms, which is the realization of the legitimate interest of both parties – the User and the Service Administrator,

d. preparing a commercial offer related to the activities of Zefir UTV Spółka z o.o., sending a Newsletter, and conducting marketing campaigns, which constitutes the realization of the legally justified interest of Zefir UTV. Such information is sent based on the User’s consent to electronic or telephone communication,

e. for the purpose and to the extent necessary to potentially establish, investigate, or defend Zefir UTV’s claims related to the use of the www.zefirutv.pl Service, which is the realization of Zefir UTV’s legitimate interest,

f. for the purpose of concluding and performing sales contracts or preliminary sales contracts concluded with the User, which is related to the conclusion of a contract at the User’s request.

2. Providing the personal data referred to in point b is voluntary and requires the User’s consent. It is necessary to provide a service quote electronically and to contact the User to answer their questions electronically or by phone.

3. Users’ Personal Data will be stored by the Administrator for a period of:

regarding data processed for the purpose of responding via the contact form – until the correspondence or contact from the User is clearly closed for the Administrator.
Data processed based on consent, i.e., Data used for sending marketing information, will be processed until the consent is withdrawn.

4. Access to personal data is limited to our selected employes and employes of our trusted subcontractors, whose services we use to maintain the functionality of the Service, who are obliged to keep the information obtained strictly confidential.

III. USER RIGHTS IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA

The User’s provision of personal data is entirely voluntary. However, failure to provide personal data makes it impossible to contact the User and for the User to use some of the services offered on the Website.
The processing of the User’s personal data for marketing purposes is based on the User’s voluntary consent. The user can withdraw their consent at any time by contacting the Administrator via email at: biuro@zefirutv.pl. Withdrawing your consent does not affect the legality of our processing of data that occurred before the withdrawal.
Users have the right to know at any time whether their Personal Data is or has been stored and to consult the Data Controller to learn about its content and origin.
By providing their Personal Data thru the Zefir UTV website, the User has the right to control data processing, access their data, rectify, correct, supplement, update, temporarily or permanently suspend its processing, delete it, restrict its processing, object to its processing, and transfer it.
The user can exercise the aforementioned rights by sending an appropriate email to the Administrator’s address: biuro@zefirutv.pl.
In case of violations regarding the data processing process, complaints should be reported to the supervisory authority, which is the General Inspector for Personal Data Protection (address: General Inspector for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

IV. Data Retention Period

Data is stored for the period necessary to provide the service requested by the User, or for the period specified for the purposes described in this document. The user can always ask the Data Administrator to suspend or delete the data. Personal Data is used for marketing purposes until the User objects to its processing for marketing purposes or until consent is withdrawn. Data related to the processing of the User’s applications as a Zefir UTV Customer submitted online is stored until the statute of limitations for claims arising from the agreement between the User and Zefir UTV expires. In the event of any potential claims by Zefir UTV arising from the use of the Website The data is stored until it expires.

V. DATA TYPES COLLECTED

Personal data is collected only to the minimum extent necessary to achieve the purposes for which it is collected. User data is protected against loss, unauthorized access, accidental loss or alteration, and other unlawful forms of processing. In situations where Personal Data is shared with other entities, this is done only in a secure, contractually protected manner and in accordance with applicable legal regulations. The retention of personal data complies with legal regulations, is limited to the time necessary to achieve the purposes for which the data is collected, unless events occur that necessitate an extension of the data storage period.
The Personal Data mentioned in this Privacy Policy may include a range of data that depends on the category of the data subject and the User’s status – whether they are already a Zefir UTV Customer, someone interested in Zefir UTV products or services, as well as the purpose for which this Data is collected. Only the necessary range of data is processed each time.
Among the personal data that may be processed are: identification data (name and surname), contact details (phone number, email address), location data, data regarding inquiries, orders, complaints, data regarding the products or services the User is interested in, information provided during a conversation or contained in correspondence addressed to Zefir UTV (including within social media), in the case of business entities, also the company name and tax identification number, contact person data (position), data related to the use of chats.
Personal Data can be freely provided by the User or automatically collected when using the website. Any use of cookies – or other tracking tools – by the service or by third-party service providers used by this service, unless otherwise specified, is for the purpose of identifying Users and remembering their preferences, solely to provide the services requested by the User. Failure to provide certain personal data may prevent the provision of services. The type of data required to be provided to handle an inquiry, order, or sign-up for a test drive is marked with an asterisk (*).
Zefir UTV collects Users’ Personal Data when they fill out the contact form on the Website, contact us by phone, subscribe to the Newsletter, or send inquiries or messages via social media platforms.
When logging into online services using social network credentials, such as Facebook, Google+, or others, the User agrees to share their data. This also includes communicating thru the Facebook chat window (after logging in), which is embedded directly on the pages. Examples of data include your first and last name, email address, date and place of birth, location, and any information you wish to share.

VI. “COOKIES” FILES

The website https://zefirutv.pl/ uses “cookies”. Failure to change the browser settings on the User’s side is tantamount to agreeing to their use.
Cookies are text files whose purpose is to collect standard internet login information and information about a User’s behavior when visiting websites. They are stored on the User’s end device and are intended for use with the website.
Only the Administrator has access to cookies. The files do not contain personal data.
The website https://zefirutv.pl/ uses two main types of cookies: session cookies and persistent cookies. “Session” files are temporary files that are stored on the User’s end device until the website is left or the web browser is closed. “Persistent” files are stored on the User’s end device for the time specified in the cookie parameters or until they are deleted by the User.
The Administrator uses marketing tools such as Facebook Pixel to target advertisements to the User. As part of these tools, we direct advertisements to you on Facebook. In this regard, the Administrator relies on a legitimate interest in the form of marketing its own services. For this purpose, the Administrator uses cookies from Facebook Inc., 1601 S. California Ave. Palo Alto, CA 94304, USA. Within the cookie settings, the User can determine whether they consent to the Administrator using the Facebook Pixel.
The Facebook Pixel allows Facebook to identify visitors to https://zefirutv.pl/ as a target audience for displaying ads on the Facebook platform. The Administrator uses Facebook Pixel to display its advertisement on the Facebook portal to individuals registered on this social networking site who have shown interest in the services provided by the Administrator. The administrator also uses Facebook Pixel to analyze the effectiveness of advertisements on Facebook for statistical purposes. The Facebook Pixel establishes a direct connection to Facebook servers during a User’s visit to the website https://zefirutv.pl/. The information collected in this way is transmitted to Facebook’s server in the United States and stored there. The information collected thru the Facebook Pixel is anonymous, meaning it does not allow the Administrator to identify you.
The administrator uses cookies to track website statistics, such as the number of visitors, the type of web browser used to view the website, the time spent on the site, the subpages visited, etc. In this regard, the Administrator uses Google Analytics, which utilizes cookies from Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. The administrator relies on a legitimate interest in the form of marketing its own services. Within the cookie settings management mechanism, the user has the option to decide whether the Google Analytics Administrator will use marketing tools as part of the service or not.

VIII. PROCESSING METHODS

The Data Administrator processes User Data correctly and takes appropriate security measures to protect against unauthorized access, disclosure, modification, or unauthorized destruction of data. 

The Administrator takes particular care to protect the interests of the Data Subjects, and in particular ensures that the Data collected by him are:

processed lawfully, fairly, and in a transparent manner for the data subject,
collected for specific, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes,
correct and updated as needed,
stored in a form that allows identification of the data subject for no longer than is necessary for the purposes for which the data are processed,
processed in a manner that ensures appropriate security of Personal Data, including protection against unauthorized or unlawful processing and accidental loss, destruction, or damage, using appropriate technical or organizational measures.

The administrator continuously conducts a risk analysis to ensure that Personal Data is processed by them securely – primarily ensuring that only authorized individuals have access to the data and only to the extent necessary for the tasks performed. The administrator ensures that all personal data operations are recorded and performed only by authorized employes and collaborators. The Administrator takes all necessary steps to ensure that its subcontractors and other collaborating entities also guaranty the implementation of appropriate security measures whenever they process Personal Data on behalf of the Administrator.

Data processing is carried out using computers and/or IT tools, in accordance with organizational procedures and methods strictly related to the indicated purposes. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of individuals responsible for the website’s operations (administration, sales, marketing, legal system administration) or to external entities (such as technical service providers, marketing services, market research, event organization and execution, call centers, transportation services, archiving, correspondence handling, postmen, couriers (in connection with order fulfillment), courier companies, hosting providers, IT companies, communication and marketing agencies, banks and payment operators, entities providing accounting, legal, auditing, consulting services, professional advisors) appointed as Data Processors by the Owner, if necessary. The current list of these sites can be obtained from the Data Administrator at any time. In some cases, third parties providing services on our behalf may act as independent administrators, such as Polish Post or other postal operators, payment transaction operators.

The Administrator reserves the right to disclose selected information about the User to the competent authorities or third parties who request such information, based on an appropriate legal basis and in accordance with applicable law.

Regarding the marketing purpose for the future, the recipients of the User’s Personal Data as Data Processor may be Authorized Dealers or Authorized Service Partners of the Zefir brand, also acting on behalf of and in the name of Zefir UTV Spółka z o.o.

It should be emphasized that if data recipients independently process Personal Data from the User on their own behalf, for example, offer products and services thru their own channels without the involvement of Zefir UTV, or provide services on their own behalf, they will become separate data controllers and in this regard bear their own responsibility for the processing of such personal data, not being subject to the terms of this Privacy Policy.

The service may contain links to other websites, social media pages, or websites of cooperating entities, financial institutions. By accessing a third-party website, Users will be subject to a separate privacy and personal data protection policy for that website. You should familiarize yourself with the privacy policies and personal data protection of individual websites.

IX. Withdrawal of Consent

In the event of processing Users’ Personal Data in connection with submitting Data as part of a quote request, test drive, or service visit, the User may withdraw their consent at any time by informing Zefir UTV of their desire to opt out of further contact via email: biuro@zefirutv.pl (loss of interest in the offer, test drive, or service visit will be tantamount to the User withdrawing their consent). For Users, Customers, or Potential Customers of the Zefir brand, withdrawing consent for future marketing purposes can be done at any time, including by contacting us via email: biuro@zefirutv.pl.

Withdrawing your consent does not have any negative consequences. However, the user must be aware that withdrawing consent means they will be unable to use services such as receiving responses, offers, or advertisements, or invitations to events, for which legal provisions require Zefir UTV to obtain the user’s consent.

The request to withdraw consent will be processed immediately. Upon the fulfillment of the request, the processing of personal data for marketing purposes, including receiving marketing and commercial information electronically and by phone, will cease. However, until the request is processed, it may happen that the User receives information they have opted out of by withdrawing their consent, due to the time required to process the request in the systems.

If Zefir UTV processes User Data for other purposes (e.g., contract fulfillment, service provision, evidence presentation, claim enforcement), it may continue to process it for those purposes under a different legal basis.

X. DATA TRANSFERS OUTSIDE THE EEA

The level of personal data protection outside the European Economic Area (EEA) differs from that provided by European law. For this reason, the Administrator transfers Personal Data outside the EEA only when necessary and with an adequate level of protection, primarily thru:

cooperation with entities processing Personal Data in countries for which an appropriate decision of the European Commission has been issued,
the use of standard contractual clauses issued by the European Commission,
the application of binding corporate rules approved by the competent supervisory authority,
In case of data transfer to the USA – cooperation with entities participating in the Privacy Shield program, approved by a decision of the European Commission.

The administrator always informs about the intention to transfer personal data outside the EEA at the stage of their collection.

User data is collected to enable the provision of services, as well as for the following purposes: analytics, further information on Personal Data, social features, interaction with external social networks and platforms, contacting the User, advertising, remarketing and behavioral targeting, email address management, and sending messages.

Some optional equipment is only available in combination with other items or specific trim levels and may only be available at an additional cost. The prices of some items may differ from those listed in this price list depending on the equipment version. Any binding agreements regarding vehicle equipment and specifications are made in an individual contract concluded between the parties each time.
